These Terms and Conditions (“Terms”) govern your use of the website www.thecloudfairy.com (the “Site”) and the purchase of any products or services offered by The Cloudfairy (“we”, “us”, or “our”). By using the Site, placing an order, or working with us, you agree to these Terms.

The Cloudfairy is a creative studio and online shop based in the Netherlands, operating in accordance with Dutch and EU consumer and business laws.

1. Scope of These Terms

These Terms apply to:

• All physical product purchases made through our shop

• Any digital downloads offered via the Site

• All custom creative services (e.g. branding, web design, animation, etc.)

• All general use of our website and contact forms

2. Products and Orders

All items in the online shop are sold as described. Minor color or shape differences (due to printing or screen variations) may occur and are not grounds for refund.

When you place an order, you agree to:

• Provide accurate and up-to-date information

• Pay the total amount shown at checkout

• Understand that handmade or small-batch items may have slight variations

We reserve the right to refuse or cancel orders for any reason, including suspected fraud or product unavailability.

3. Services and Studio Work

Custom services (e.g. branding, illustration, websites) are provided based on individual agreements made via email or written proposal. A separate contract or written confirmation may outline:

• Project scope and timeline

• Fees and payment schedule

• Ownership and licensing

• Revisions and cancellation terms

You may not reproduce, modify, or resell any creative work without prior written permission.

4. Pricing and Payment

All prices of products listed on the Site are in euros (EUR) and include 21% VAT (for physical products, unless otherwise stated).
Service pricing may vary per project and is quoted individually and all prices of services listed on the Site are in euros (EUR) and exclude VAT.

Payments are securely processed via third-party providers such as Stripe or iDEAL. We do not store or process your credit card details directly.

5. Shipping and Delivery

Orders are shipped from the Netherlands via PostNL within 2–3 business days, unless otherwise noted.
Delivery estimates:

• Netherlands: 1–2 business days

• EU: 3–10 business days

• International: 5–14+ business days

We are not responsible for delays caused by postal services, customs, or incorrect shipping information.

Currently, shipping does not include tracking by default.

6. Returns and Refunds

If you’re unhappy with your order, contact us at support@thecloudfairy.com within 14 days of receiving it.
Refunds or replacements are handled on a case-by-case basis. You may be asked to return the item (unused and in original condition) at your own cost.

The following are not eligible for return or refund:

• Digital downloads

• Custom work or commissioned services

• Items damaged due to misuse or postal issues outside our control

7. Intellectual Property

All content on this Site, including artwork, logos, text, and design, is the intellectual property of The Cloudfairy (unless otherwise stated).

You may not copy, reproduce, resell, or distribute our work or products without written permission.

8. Limitation of Liability

We are not liable for:

• Indirect, incidental, or consequential damages

• Delays or errors caused by third-party services (e.g. shipping carriers, payment providers)

• Any loss resulting from the misuse of our products or services

Use of the Site and its content is at your own risk.

9. Privacy and Data Use

We collect and process personal data in accordance with our Privacy Policy (link to full policy).
By using the Site or purchasing from us, you agree to the collection and use of your data as described.

10. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we’ll revise the “Effective Date” at the top of this page. Continued use of the Site after updates means you accept the new Terms.

11. Governing Law

These Terms are governed by the laws of the Netherlands.
Any disputes shall be handled by the competent courts of the Netherlands.
